Part 1 — About this site
1.1 Who we are

In these terms, "we" and "us" mean Gary WizArt, and "you" means anyone visiting the site or buying from it.
1.2 How these terms fit together
Part 1 applies to everyone who visits the site. Part 2 applies when you buy something. Part 3 covers the law that applies and how disagreements are handled. Our Privacy Policy and Cookie Policy explain how we handle personal data and cookies.
1.3 The artwork and words on this site
The illustrations, characters, stories, texts and designs on this site are created by Gary Germain and protected by copyright. You are welcome to look, share links and enjoy them. Please do not copy, reproduce, sell, adapt or otherwise use them without written permission.
We reserve all rights to use this site's content for text and data mining, including training artificial intelligence systems. Buying a print, book or garment gives you the physical item, not any rights in the artwork on it.
1.4 Using the site
Please use the site in the normal way: to read, browse, subscribe and shop. Do not try to disrupt it, gain access to parts not meant for you, or collect other people's data from it.
We work to keep the site available and accurate, but it may occasionally be unavailable or contain a mistake. When we find an error, we correct it.
1.5 Links to other sites
The site links to other places, such as Instagram, Pinterest and YouTube. Those sites have their own terms and privacy rules, and we are not responsible for their content.
Part 2 — Terms of Sale
These terms apply to every order placed on garywizart.com. The version that applies is the one published when you place your order. Before paying, you can read them at checkout; after paying, the order confirmation email links back here.
2.1 What we sell
We sell illustrated children's books, art prints and clothing featuring Gary WizArt illustrations. Each item is produced by our print partner after you order it, then packed and sent to you. Product pages describe each item as accurately as we can; colours on screen may differ slightly from the printed result.
2.2 Prices
Prices are in euros and include VAT. Delivery costs, if any, are shown before you pay. Orders sent outside the European Union may be charged import duties or taxes by the destination country; these are set by that country, are not collected by us, and are paid by the recipient.
2.3 How an order works
-
Add items to your cart and go to checkout.
-
Enter your details and delivery address, choose a delivery option and review your order. You can correct any mistake before paying.
-
Pay. Your order is placed when you confirm payment.
-
We send an order confirmation email with a summary of your order, a reminder of your 14-day right to cancel, and a link to these terms and the withdrawal form. Please keep it; we also keep a record of your order.
The contract is concluded in English.
2.4 Payment
Payments are processed securely by Wix Payments. You can pay with the cards and wallets shown at checkout. Your card details go directly to the payment provider; we never see or store them.
2.5 Delivery
We deliver to France, Spain, the United Kingdom, Canada and the United States. Orders usually take 7 to 11 business days to produce and ship, and delivery times depend on the destination. If we cannot deliver within 30 days of your order, we will tell you, and you may cancel for a full refund.
When your order ships, we send tracking details by email.
2.6 Changing your mind: 14-day right of withdrawal
You can cancel your order without giving a reason within 14 days of the day you, or someone you name, receive the item. For an order delivered in several parcels, the 14 days start when you receive the last one.
To cancel, tell us clearly before the 14 days end: send an email to shop@garywizart.com or use the model withdrawal form below. You then have 14 days from telling us to send the items back.
We refund everything you paid, including the standard delivery cost, within 14 days of receiving your cancellation. We use the same payment method you used, at no cost to you. We may wait to refund until we receive the items back or you show proof of sending them, whichever comes first.
You pay the direct cost of sending the items back to us.
You are responsible for any loss in value caused by handling the items beyond what is needed to check them, as you would in a shop.
The right of withdrawal does not apply to items made to your own specifications or clearly personalised for you, such as a dedication written at your request. We will always tell you before you order if an item falls in this category. A standard signature on a print does not make it personalised.
2.7 If something is wrong: legal guarantee
Every item is covered by the legal guarantee of conformity. Under Spanish law, we are responsible for any lack of conformity that appears within three years of delivery. If an item is faulty or not as described, we will repair or replace it; where that is not possible, you are entitled to a price reduction or a refund. If you live in another country, you also keep the guarantee rights your own country's law gives you.
2.8 Damaged in transit
If an item arrives damaged, please email shop@garywizart.com as soon as you can with photos of the item and its packaging. It helps us sort it out with our print partner quickly. Reporting late does not remove your rights under the legal guarantee.
2.9 Questions and complaints
For any question or complaint about an order, email shop@garywizart.com with your order number. We reply as soon as possible and in any case within one month.
2.10 Model withdrawal form
Complete and return this form only if you wish to cancel your order. You can also simply send us an email saying so.

Part 3 — Law and disputes
3.1 Applicable law
These terms are governed by Spanish law. If you buy as a consumer and live in another country, you keep the protection of the mandatory consumer laws of the country where you live. Nothing in these terms takes away rights that the law gives you.
3.2 Our responsibility
We are responsible for the items we sell as set out in Part 2. We do not limit our liability where the law does not allow it, including for death or personal injury caused by negligence, for fraud, or under the legal guarantee.
3.3 Resolving a disagreement
If something goes wrong, please write to shop@garywizart.com first; most problems are solved quickly that way. If we cannot agree, you may go to the courts of the place where you live, or contact your local consumer authority. We are not signed up to any alternative dispute resolution body.
3.4 Changes to these terms
We may update these terms, for example when the law or our shop changes. The date at the top shows the latest version. An order is always governed by the version published when it was placed.
